THE ‘JUDICIAL PRECEDENT’: A FIGURE OF OTHERS TO COLOMBIAN SYSTEM OF SOURCES OF LAW
description The analysis of the issue of “judicial precedent” or “jurisprudence”, in the light of the relevant constitutional and legal norms, the jurisprudence of the Constitutional Court and designated by two (2) indoctrinators, whose authority on the subject is widely recognized doctors Diego Eduardo López Medina and Carlos Bernal Pulido - has allowed me to conclude, as I intend to demonstrate in this essay, this figure is alien to the legal policy of the Colombian State organization and judicial practice in the it develops.The strong influence of common law in our legal system and constitutional interpretation makes judges today link their decisions not only legal content, but the decisions of senior judges especially human rights, and structuring a new form of understand the law, grounded, not in the positivist model, but through systematic interpretation by the court on the rights and especially those enshrined in the constitution itself, applying criteria of fairness and proportionality to be applied in the solving future cases.It is sufficient to observe the definition of “judicial precedent” to note that this figure does not fit the system design sources in Colombian law “in which only gives the jurisprudence character supplementary source formal law, as well as auxiliary criteria of judicial activity; so that in a legal-political system in which judicial decisions are extra formal source of law and criteria guiding non-binding judicial activity, the quality of main formal source of law and binding judgment of the work of judges, which the Constitutional Court has granted its doctrine on human rights contained in the review sentences fault protection, as well as the constant jurisprudence of the so-called High Courts, it lacks legal support.

El análisis del tema del “precedente judicial” o “jurisprudencial”, a la luz de las normas constitucionales y legales pertinentes, de la jurisprudencia de la Corte Constitucional y de lo señalado por dos (2) doctrinantes, cuya autoridad sobre el tema es ampliamente reconocida los doctores Diego Eduardo López Medina  y Carlos Bernal Pulido-, me ha permitido concluir, como pretendo demostrarlo en el presente ensayo, que esta figura resulta extraña a la organización jurídico-política del Estado Colombiano, así como a la práctica judicial que dentro del mismo se desarrolla.En efecto, basta con observar la definición de “precedente judicial” , para notar que dicha figura no se ajusta al diseño del sistema de fuentes en el derecho colombiano, en el cual apenas otorga a la jurisprudencia el carácter de fuente supletoria formal de derecho, así como de criterio auxiliar de la actividad judicial; de suerte que en un sistema jurídico-político donde las decisiones judiciales constituyen fuente formal supletoria del derecho y criterio orientador, no vinculante, de la actividad judicial, la calidad de fuente formal principal del derecho y criterio vinculante de la labor de los jueces, que la Corte Constitucional le ha otorgado a su doctrina sobre los derechos humanos contenida en las sentencias de revisión de fallos de tutela, así como a la jurisprudencia constante de las denominadas Altas Cortes, carece de soporte jurídico.La marcada influencia del derecho anglosajón en nuestro ordenamiento jurídico, y en la interpretación constitucional hace que los jueces hoy vinculen en sus decisiones no solo el contenido legal, sino las decisiones de jueces superiores especialmente en materia de derechos humanos, estructurándose así una nueva forma de entender el derecho, fundamentada, ya no, en el modelo positivista, sino a través de la interpretación sistemática que hace la corte sobre los derechos y en especial los consagrados en la propia constitución, aplicando criterios de equidad y proporcionalidad, para ser aplicados en la solución de casos futuros. L’analyse de la question de la «jurisprudence» ou «jurisprudence», à la lumière des normes constitutionnelles et juridiques pertinentes, la jurisprudence de la Cour constitutionnelle et désigné par deux (2) endoctrineurs, dont l’autorité sur le sujet est largement médecins reconnus Diego López Eduardo Medina et Carlos Bernal Pulido - m’a permis de conclure, comme je l’intention de démontrer dans cet essai, ce chiffre est étranger à la politique juridique de l’organisation de l’Etat colombien et la pratique judiciaire dans le il se développe ..Il suffit d’observer la définition de «jurisprudence» de noter que ce chiffre ne correspond pas aux sources de conception du système dans la loi colombienne “dans laquelle seule donne le caractère de la jurisprudence source supplémentaire loi formelle, ainsi que des critères auxiliaires de l’activité judiciaire; de sorte que dans un système juridico-politique dans lequel les décisions judiciaires sont la source officielle supplémentaire de la loi et les critères directeurs de liaison non-activité judiciaire, la qualité de principale source formelle du droit et de jugement contraignant du travail des juges, la Cour constitutionnelle a accordé sa doctrine sur les droits contenus dans la protection examinent des peines de défaut, ainsi que la jurisprudence constante de la haute Cour soi-disant, il lui manque un soutien juridique.La forte influence de la common law dans notre système juridique et l’interprétation constitutionnelle rend les juges aujourd’hui lier leurs décisions non seulement de contenu juridique, mais les décisions des juges de haut rang en particulier les droits humains et la structuration d’une nouvelle forme de comprendre la loi, à la terre, et non pas dans le modèle positiviste, mais grâce à l’interprétation systématique par le tribunal sur les droits et en particulier ceux qui sont consacrés dans la constitution elle-même, en appliquant des critères d’équité et de proportionnalité à appliquer dans le résoudre les cas futurs. 2016-01-01 info:eu-repo/semantics/article info:eu-repo/semantics/publishedVersion http://revistas.ustatunja.edu.co/index.php/piuris/article/view/1123 spa http://revistas.ustatunja.edu.co/index.php/piuris/article/view/1123/1086 Derechos de autor 2016 Principia Iuris application/pdf Universidad Santo Tomas de Aquino Seccional Tunja Principia Iuris; Vol. 13 Núm. 25 (2016); 77-98 0124-2067
