%0 Tesis de maestría (Master Thesis) %A Molina Alarcón, Ginna Tatiana %D 2016 %G Español (Spanish) %T Tribunal de justicia andino: Herramienta arbitral para los países de la CAN %U https://hdl.handle.net/10901/9876 %X Los países que conforman la Comunidad Andina, han tenido gran progreso respecto al comercio internacional debido a la eliminación de barreras arancelarias entre países andinos desde el año 2005, y con ello se han ratificado nuevos acuerdos de libre comercio entre éstos países latinoamericanos, con el fin de fomentar el comercio de bienes y servicios. El Tribunal de Justicia de la Comunidad Andina, fue constituido a través del Estatuto de creación del Tribunal, mediante el cual se establecen sus funciones jurisdiccionales respecto de las acciones en las que resuelve, interpreta y aplica el derecho comunitario. No obstante, el articulo 38 del mencionado estatuto, comprende como mecanismo alternativo la función arbitral para solucionar las controversias respecto a la aplicación e interpretación de contratos, convenios o acuerdos; que se susciten entre órganos e instituciones del Sistema Andino de Integración –SAI-, éstos y terceros, y particulares cuando así lo pacten. Por tanto, los Estados parte no podrían resolver sus controversias por arbitraje en el Tribunal de Justicia Andino, sino solo como terceros, estando obligados a acudir a otras instituciones de arbitraje, lo que significa la vulneración al principio del acceso a la justicia arbitral para los Estados miembros, dentro de la Comunidad Andina. Si bien es cierto, que el mercado andino se ha fortalecido debido a la inversión nacional y extranjera a fin de promover el intercambio de bienes y servicios, con esto también aumenta la posibilidad que se presenten conflictos, para lo cual se requiere de un mecanismo expedito y eficaz por cuenta del derecho andino que respalde la integración y desarrollo de los países miembros de la Comunidad Andina, como seria el arbitraje a cargo del Tribunal de Justicia de la Comunidad Andina para las controversias comerciales entre los Estados.
