El estudio se efectuará a partir del análisis de las sentencias del tribunal superior del distrito judicial de Cúcuta, sala civil especializada en restitución de tierras entre los años 2012 y 2017. También se busca poner en evidencia las diferencias sustanciales en el trato que se le da dentro del proceso de restitución a la víctima y el opositor, y cómo estas han impuesto cargas excesivas al opositor que junto a las falencias de defensa, conocimiento y recursos económicos limitan su actuar e impactan negativamente la decisión que tomará el juez sobre estos, aclarando y distinguiendo los conceptos de opositor con buena fe exenta de culpa y segundo ocupante desde lo normativo, bloque de constitucional y la sentencia C- 330 de 2016 de la corte constitucional. The present work will investigate the procedural position, the evidentiary capabilities and the means available to the opponent in general to achieve good faith without guilt and if according to the requirements established by the law and jurisprudence is in the ability to obtain it. The study will be conducted from the analysis of the judgments of the superior court of the judicial district of Cucuta, civil chamber specialized in land restitution between 2012 and 2017. It also seeks to highlight the substantial differences in the treatment that is given within the process of restitution to the victim and the opponent, and how they have imposed excessive burdens on the opponent that together with the shortcomings of defense, knowledge and economic resources limit its act and negatively impact the decision that the judge will take on these, clarifying and distinguishing the concepts of opponent with good faith free of guilt and second occupant from the normative, constitutional block and the ruling C-330 of 2016 of the constitutional court.
