This sector occupied the fourth position between 17 Sectors, which has caused losses social and economic issues for the Government, the Companies and the workers’ family. Objective: To establish the relationship between the occupational health and safety management system under Decree 1072 of 2015 in its Chapter VI, with the Workplace Accidents of 12 PYMES companies of the construction sector of the city of Santiago de Cali in the years 2015 - 2016. Methods: Descriptive-quantitative. The items of Decree 1072 of 2015 were systematized, in order to determine the compliance percentage of all the companies per year, then the work accidents investigations were systematized and their rate was determined, to compare them with the compliance percentages of each year to through a linear regression and make a prediction. Results: The lower the occupational health and safety management systems compliance (OH_SMS), the higher the accident rate. Conclusions: It is concluded that there is a non-unique, but multifactorial relationship between the Legal Compliance of the OH_SMS, with the work accidents, where a company that presents a % compliance (51.4%), its probable accident rate will be 2 %, so that by increasing (1.8 %), the work accidents rate will decrease 1 % En el sector de la construcción en el 2015 se presentó una tasa de accidentalidad del 10.4 % y una tasa de mortalidad del 11.5 %.
