Sumario:This article states that, in the context of transitional justice in Colombia, the success of the land restitution policy depends to a large extend on the institutional capacity to counteract the causes and consequences of internal forced displacement. Thus, it explains that the majority of the forcible displaced victims belongs to historically marginalized population groups and excluded from the exercise of their rights; it identifies what have been main factors of dispossession and forced abandonment of land linked to forced displacement that allow it to be explained as a war practice for accumulation; it approaches the public policy of attention to internally forced displaced population as a sum of insufficient efforts to overcome the unconstitutional state of affairs declared in 2004; and, starting from there, it reflects on the limitations on the land restitution policy, after five years of its implementation, for the return and / or relocation of the victims, under guarantees of non-repetition of the facts that led to massive and systematic violations of their Human Rights.
