This paper examines the mechanisms for citizen participation, based on the Colombian political constitution of 1991, taking successful experiences in comparative law in a number of cases in the United States, Italy, Switzerland, and Uruguay as a role model. This analysis consists of a review of the introduction, regulations, and operation of these mechanisms, with a view to finding the causes for which they have not worked efficiently. The study concludes by demonstrating that these causes are linked to the manner in which rules are established, the object (topics) to be regulated, and the structure (processes) that is designed and built for proceduralization with regard to their functionality. It is as of that moment when their existence, configuration, and scope can be assessed for the purpose of establishing their compatibility and weighing their effective use.
El artículo examina los mecanismos de participación ciudadana, a partir de la Constitución política de 1991 en Colombia, teniendo como modelo las experiencias exitosas del derecho comparado en los casos de Estados Unidos de Norteamérica, Italia, Suiza y Uruguay. En su análisis revisa su introducción, regulación y operatividad con el propósito de encontrar las causas por las cuales no han funcionado eficientemente. Concluye el estudio demostrando que estas se encuentran en la forma (reglas) que se establezcan, el objeto (materias) que se pretende regular (requisitos) y la estructura (procesos) que se diseñe y construya para la procedimentalización en relación con su funcionalidad. A partir de ese momento se podrá evaluar su existencia, configuración y extensión con la finalidad de establecer su compatibilidad y de ponderar la utilización efectiva
O artigo examina os mecanismos de participação dos cidadãos a partir da constituição política de 1991 na Colômbia, tendo como modelo as experiências bem sucedidas de direito comparado, nos casos dos Estados Unidos da América, Itália, Suíça e Uruguai. Em sua análise revê sua introdução, regulação e funcionamento, a fim de encontrar os motivos por que não funcionaram de forma eficiente. O estudo conclui demonstrando que estes se encontram na forma (regras) definida, no objeto (matérias) que se pretende regular (requisitos) e na estrutura (processos) que for projetada e construída para o procedimento com relação a sua funcionalidade. A partir desse momento se poderá avaliar sua existência, configuração e extensão a fim de determinar sua compatibilidade e ponderar seu uso efetivo.
