The penal process is considered essentially as an instrument of the State of Right that is based in the presumption of innocence, like it corresponds to the pattern of the due process, in front of the pattern of the social control of the crime, in which the process comes to be an instrument more than the State in the fight against the crime. The function of the penal process, separated naturally that this has for object the explanation of the punishable fact and the eventual participation in the same of the accused, the application, then, of the material penal right, it is the protection of imputed which should be presumed innocent until the moment of the firm sentence. It means, basically that should be respected the person’s dignity, the presumption of innocence, and the regulations/guarantees of the due process.
El proceso penal es considerado esencialmente como un instrumento del Estado de Derecho, que se fundamenta en la presunción de inocencia, como corresponde al modelo del debido proceso, frente al modelo del control social del delito, en el que el proceso viene a ser un instrumento más del Estado en la lucha contra el delito. La función del proceso penal, aparte naturalmente de que éste tenga por objeto la aclaración del hecho punible y la eventual participación en el mismo del acusado, la aplicación, pues, del derecho penal material, es la protección del imputado, que debe ser presumido inocente hasta el momento de la sentencia firme. Ello significa, básicamente, que debe respetarse la dignidad de la persona, la presunción de inocencia, y las reglas/garantías del debido proceso.
