Sumario:This article seeks to demonstrate that the current constitutional and legal framework, regarding the profiles of candidates for the Honorable Congress of the Republic of Colombia, it falls short on requirements of ethical and moral, for setting the requirements for access, to the legislative branch of government. This means that in such corporation, lives permanently Colombian democracy as their delegates, representing the people, in making important decisions with implications, of all kinds, political, social, economic, cultural, fiscal, financial, and others. The thesis we defend is built from the principles of the rule of law as a state where the main character is the common citizen, the ordinary citizen, that in terms of Ferrajoli, correspond to the protection of fundamental rights as weaker law. For this study, we rely on three foundational topics, namely: (i) the ad- equacy of management concerning legal pro- files for aspirants to the honorable Congress of the Republic of Colombia, (ii) effects on par- ticipatory democracy versus political exercise eligibility parliamentary around profiles of the candidates, (iii) social reality and democratic participation: in search of a political exercise in favor of citizens
