Sánchez Novoa, Pedro Alirio 2013-06-01 https://revistas.unilibre.edu.co/index.php/academia/article/view/2462 10.18041/2215-8944/academia.6.2462 This article discusses the civil procedure system of Colombia, in the light of the two procedural aspects (lnquisitive and Adversaria!), to determine whether the implementation of the General Code of Procedure, by adopting a more adversaria! system that allows prompt justice and effective by the oral and what influence the social state of law with the application of the procedural system, with respect to the decree of evidence ex officio, since to be a must-order, the judge often compromise their impartiality satisfy the substantive law, but at what cost, transgressing the constitutional and procedural principie of equality of the parties. En este artículo se analiza el sistema procesal civil de Colombia, a la luz de las dos vertientes procesales (Inquisitivo y Adversaria!), para establecer si con la implementación del Código General del Proceso, al adoptar un sistema más Adversaria! que permita una justicia pronta y efectiva por la oralidad y que influencia tiene el estado social de derecho con la aplicación de dicho sistema procesal, en lo que respecta al decreto de pruebas de oficio, toda vez que por ser un deber-poder, el juez muchas veces comprometer su imparcialidad para satisfacer el derecho sustancial, pero a que costo, trasgrediendo el principio procesal y constitucional de la igualdad de las partes. application/pdf spa spa Universidad Libre https://revistas.unilibre.edu.co/index.php/academia/article/view/2462/1897 /*ref*/Arredondo, B.
