Sumario: | El principio de exhaustividad es un postulado orientador de la actividad judicial, su trascendencia se inscribe tanto en el ámbito nacional como internacional e impone a los operadores judiciales responder los puntos base del litigio, sin ser dable omitir asuntos fundamentales para el proceso. Dicho esto, el presente trabajo tiene como objeto analizar el principio de exhaustividad desde la óptica de la Corte Interamericana de Derechos Humanos y el Tribunal Europeo de Derechos Humanos. Para lo anterior, el trabajo en un primer momento estudia los elementos del principio de exhaustividad desde la perspectiva del Sistema Interamericano de Derechos Humanos; posteriormente identifica los elementos del principio de exhaustividad conforme al Sistema Europeo de Derechos Humanos. Finalmente, el último capítulo contiene la identificación de las diferencias que compone el principio de exhaustividad desde el desarrollo jurisprudencial. Además, se establece como último apartado conclusiones frente al tema de estudio.
The principle of completeness is a postulate guiding the judicial activity, its importance is inscribed both nationally and internationally and imposes on the judicial operators to answer the basic points of the litigation, without being able to omit issues fundamental to the process. Having said this, the purpose of this paper is to analyze the principle of completeness from the perspective of the Inter-American Court of Human Rights and the European Court of Human Rights. For the above, the work at first looks at the elements of the principle of completeness from the perspective of the Inter-American Human Rights System; it subsequently identifies the elements of the principle of completeness in accordance with the European System of Human Rights. Finally, the last chapter contains the identification of the differences that make up the principle of completeness from the jurisprudential development. In addition, conclusions are established as the last section in relation to the study topic
