%0 Tesis de maestría (Master Thesis) %A Calderón Ibarra, Astrid Johana %D 2017 %G Español (Spanish) %T La desobediencia civil de John Rawls, recepción y manejo en la jurisprudencia de la corte constitucional colombiana, durante los años 1992 a 2016 %U https://hdl.handle.net/10901/11454 %X Se pretende a continuación abordar la teoría de la desobediencia civil, expuesta por John Rawls en su libro Teoría de la Justicia, así como la manera en que el Tribunal Constitucional Colombiano ha recepcionado la teoría. Cabe advertir que el filósofo estadounidense se permite precisar en más de una oportunidad, que el ejercicio de la desobediencia civil solo es posible en una sociedad “casi justa”, no es viable considerar que es válida en cualquier contexto, sin tener presente las condiciones políticas, jurídicas, sociales y económicas de la organización social. El ejercicio de la mencionada forma de resistencia solo es posible si se cumplen los siguientes requisitos; (a) en primer lugar, es menester que exista un régimen constitucional, es decir una Constitución que organice al ente estatal tanto en su parte orgánica como dogmática; (b) también es requisito sine qua non que se haya construido una concepción de justicia aceptada por la mayor parte de la población, en otras palabras la idea de justicia que se ha consagrado en la constitución, ha debido ser interiorizada, vivida y aceptada por el grueso de personas que integran una determinada comunidad, (c) Finalmente en esa sociedad donde es posible hacer uso de la desobediencia civil, debe existir un régimen de gobierno democrático que se haya instituido legítimamente, esto es con respeto del proceso democrático, la constitución y las leyes. No obstante, pese a ser una sociedad que funciona bien en términos generales, se producen violaciones a la concepción de justicia que han reconocido sus integrantes. Por ello, con el ánimo de corregir dichas situaciones los ciudadanos cuentan con herramientas de defensa a los principios consensuados consagrados en el pacto. The aim is then to address the theory of civil disobedience, exposed by John Rawls in his book Theory of Justice, as well as the way in which the Colombian Constitutional Court has received the theory. It should be noted that the American philosopher is allowed to specify more than once, that the exercise of civil disobedience is only possible in an "almost fair" society, it is not viable to consider it valid in any context, without bearing in mind the political conditions , legal, social and economic aspects of social organization. The exercise of the aforementioned form of resistance is only possible if the following requirements are met; (a) First of all, it is necessary to have a constitutional regime, that is, a Constitution that organizes the state entity, both in its organic and dogmatic part; (b) it is also a sine qua non requirement that a conception of justice accepted by the majority of the population has been constructed, in other words the idea of justice that has been enshrined in the constitution, has had to be internalized, lived and accepted by the bulk of people that make up a certain community, (c) Finally in that society where it is possible to make use of civil disobedience, there must be a democratic government regime that has been legitimately instituted, this is with respect to the democratic process, the constitution and the laws. However, despite being a society that works well in general terms, there are violations of the conception of justice that its members have recognized. Therefore, in order to correct these situations, citizens have tools to defend the agreed principles enshrined in the agreement.
