Sumario:In this article, it is proposed as possible and necessary to undertake the configuration of an international criminal law, while knowing, whose task be to limit the exercise of punitive power, this way tending for the real validity of human rights; for it, one has to distinguish the concepts of international punitive power, international criminal legislation and criminal law of the same nature. Presenting afterwards general and specific guidelines of that system of international criminal law.The above, in order to provide a real validity of human rights, or what is the same, the real and full wellbeing of the people.
